ISLAMABAD: President Asif Ali Zardari, in the spirit of national and religious celebrations, has approved a special remission in prisoners’ sentences on the occasion of Pakistan Day and Eid ul Fitr.
This decision was announced on Friday and comes as part of a longstanding tradition where sentence reductions are granted on significant national and religious events.
Pakistan Day, observed annually on March 23, marks the historic Lahore Resolution of 1940, a key milestone in the country’s struggle for independence. Eid ul Fitr, on the other hand, is one of the most significant Islamic festivals, celebrated at the end of Ramadan.
In recognition of these important occasions, President Zardari exercised his constitutional authority under Article 45 of the Constitution of Pakistan to grant a remission of 180 days in prison sentences.
However, this relief is subject to specific conditions and does not apply to all prisoners. Those convicted of serious crimes, including murder, espionage, and activities against the state, are not eligible for sentence reduction.
Additionally, individuals serving sentences for crimes such as rape, theft, robbery, kidnapping, terrorism, and financial offenses are also excluded from this benefit.
The remission will primarily benefit elderly prisoners and juveniles who meet certain criteria. Male prisoners above the age of 65 and female prisoners over 60, who have already served at least one-third of their sentence, will qualify for the reduction.
Similarly, juvenile offenders who have completed one-third of their sentence will also be entitled to this remission.
Granting sentence remissions on special occasions has been a longstanding practice in Pakistan, often observed during key national events like Independence Day and major religious festivals.
These decisions are usually taken to uphold humanitarian considerations, recognizing the potential for rehabilitation and reintegration of certain prisoners into society.
This initiative by President Zardari reflects the government’s commitment to balancing justice with compassion, allowing deserving individuals a chance at early release while ensuring that those convicted of serious offenses remain accountable for their actions.
